The self-styled super hero ran in to break up a fight between a small group and a large group. He used pepper spray to fend off the fighters after he was attacked. He's been charged with four counts of assault.

The man was just a costumed citizen. The police are costumed citizens with PERMISSION to assault, detain, kidnap and imprison you... Or, when it's easier, kill you.

Would the fighters have been pepper sprayed and arrested if the police had shown up first? Is it assault when the police pepper spray someone?
