She didn't let him off scott free, but she recognized that time in jail was not going to help this man overcome his drug problem. Coudos to this judge Diane Nicolosi.

The article did not say if the person threatened or coerced the pharmacy to grant the prescription. It just states that the person falsified the prescription. Just because some legislature or worse, regulator, decides that some chemical has a certain class does not make lying to get it a crime. The transaction was between the pharmacy and the individual. If the pharmacy believes that the individual falsified data to get the chemical then the pharmacy can say no to the sale. So the correct response of a "JUST" judge would be to release the poor fellow and pay have the state pay him cash for his kidnapping. But this judge with the idiot attorney for the defense suggests PROBATION? Ask Ian and Mark here how good of a deal probation is. For example in some states you violate your probation for talking to another convict, how the hell do you know if someone is a convict or not? Plus you may be poor and need to live in a bad neighborhood or a not so bad one but you violate your probation if you or your significant other keeps a gun.
