This Graham guy assumes that being "affiliated with Al-Queda" is a black-and-white determination, one that the (arguably biased) military and police would have the sole capability to do. That's actually what courts are for: to make that determination. If we allow military and police (or even the federal intelligence agencies) to decide which American citizens are terrorists and which are not a terrorists, we open the door to all kinds of abuses, irrational determinations, mistakes made in haste, and the like. Frankly, I don't think drones should be used to bomb anybody unless they're trying to bomb us first. Everything else deserves due process.
And all of this language belies the real question of whether Al-Queda is even a real threat to anyone anymore, and also whether we still are, or ever were, "at war" with an intangible entity such as "terror", either legally or de facto.
Graham can stuff it.
