Miami Beach police did their best to destroy a citizen video that shows them shooting a man to death in a hail of bullets Memorial Day.

First, police pointed their guns at the man who shot the video, according to a Miami Herald interview with the videographer.

Then they ordered the man and his girlfriend out the car and threw them down to the ground, yelling “you want to be fucking paparazzi?”

An eyewitness to a fatal police shooting in Miami Beach last week claims police officers attempted to confiscate the video he filmed of the incident, and even crushed his phone underfoot in an attempt to destroy the recording.
"When he noticed me recording, one of the officers jumped in the truck, put a pistol to my head," he said. "My phone was smashed - he stepped on it, handcuffed me."

The City of Boston has agreed to pay Simon Glik $170,000 in damages and legal fees to settle a civil rights lawsuit. Glik was arrested in 2007 on Boston Common for using his cell phone to record the arrest of another man. Police then arrested Glik, too, and charged him under the strict Massachusetts wiretapping statute. They eventually dropped the charges, but with the help of the Massachusetts ACLU, Glik filed a civil lawsuit against the city for false arrest.

"A man in Weare, New Hampshire was charged with felony wiretapping for recording the police during a traffic stop — based on a cell phone call he made as an officer approached his vehicle. From the article: Police considered it wiretapping because the call was being recorded by a voice mail service without the officer's consent."

An incidental recording taken while a Florida woman was on the phone with her insurance company shows that the police who arrested her and charged her with a felony for resisting arrest lied in their reports, and then again under questioning.

The settlement follows a landmark ruling last August by the U.S. Court of Appeals for the First Circuit, declaring that the First Amendment protects the right to record police carrying out their duties in a public place...

"The law had been clear for years that openly recording a video is not a crime..."

The court's opinion made clear that people cannot be arrested simply for documenting the actions of police officers in public...

"The First Amendment includes the freedom to observe and document the conduct of government officials, which is crucial to a democracy and a free society."
