A federal appeals court said Tuesday the government may obtain cell-site information that mobile phone carriers retain on their customers without a probable-cause warrant under the Fourth Amendment.

WASHINGTON -- A police officer can't pull you over and arrest you just because you gave him the finger, a federal appeals court declared Thursday. In a 14-page opinion, the U.S. Court of Appeals for the 2nd Circuit ruled that the "ancient gesture of insult is not the basis for a reasonable suspicion of a traffic violation or impending criminal activity."

The Michigan State Police have a high-tech mobile forensics device that can be used to extract information from cell phones belonging to motorists stopped for minor traffic violations. The American Civil Liberties Union (ACLU) of Michigan last Wednesday demanded that state officials stop stonewalling freedom of information requests for information on the program.

A three-judge panel found that even if the officer observed no illegal conduct, a traffic stop and interrogation is justified when a driver seems not to want to be around a patrol car.

A District Court judge in Goffstown, New Hampshire has dismissed a criminal charge against a Weare man for recording his conversation with a police officer during a traffic stop. Judge Edward Tenney followed a recent First Circuit Court of Appeals decision in Boston in Glik v. Cunniffe in ruling that William Alleman was within his constitutional rights when making an audio recording of Weare Police Officer Brandon Montplaisir during the traffic stop on July 10, 2010.

A New Jersey man who was strip searched in prison after being accused of failing to pay a traffic fine lost his Supreme Court appeal Monday.

When a deputy sheriff began questioning Melissa Greenfield's boyfriend at a Delaware County truck stop, she began recording video with her cell phone.
She never thought that she, or her phone, could be viewed as a danger as she documented the activities of public employees in a public place.
"I'm a 115-pound, 20-year-old girl wearing a cervical collar with nothing but a cell phone. I was not going to harm any officer," Greenfield said yesterday.
