SOPA and PIPA have been shelved but the government’s plan to censor the public is an ongoing threat. Enter the "Anti-Counterfeiting Trade Agreement" aka ACTA, an international trade agreement whose supposed sole purpose is to forge ahead with tackling counterfeited goods and -- suprise, surprise -- copyright infringement.

What is ACTA?

ACTA is an international trade agreement currently being negotiated by the European Union, the United States, Japan, Canada, South Korea, Australia as well as a few other countries, whose aim is to enforce copyright and tackle counterfeited goods (hence its acronym: Anti-Counterfeiting Trade Agreement).

When sites like Wikipedia and Reddit banded together for a major blackout January 18th, the impact was felt all the way to Washington D.C. The blackout had lawmakers running from the controversial anti-piracy legislation, SOPA and PIPA, which critics said threatened freedom of speech online.

Unfortunately for free-speech advocates, these pieces of legislation are not the only laws which threaten an open internet.

The internet is still rejoicing after last week’s win over ACTA. The European Parliament overwhelmingly voted down the treaty which effectively kills it for the time being. It will be back later, but the Internet can celebrate another win for now. While our friends in Europe our celebrating, the U.S. must still be on the offensive in regards to the ever elusive Trans-Pacific Partnership Agreement.

Given the history of ACTA leaks, to no one's surprise, the latest version of the draft agreement was leaked last night on KEI's website. The new version - which reflects changes made during an intense week of negotiations last month in Washington - shows a draft agreement that is much closer to becoming reality. Square brackets have been removed from many sections, leaving the core issue of scope of the agreement as the biggest issue to be resolved when the next round of negotiations begins in a few weeks in Japan. A draft agreement leaked Wednesday shows the Obama administration is pushing a secretive trade agreement that could vastly expand corporate power and directly contradict a 2008 campaign promise by President Obama. A U.S. proposal for the Trans-Pacific Partnership (TPP) trade pact between the United States and eight Pacific nations would allow foreign corporations operating in the U.S. to appeal key regulations to an international tribunal. The body would have the power to override U.S. law and issue penalties for failure to comply with its ruling.

Mass action on January 18, 2012 won a small victory for opponents of the internet censorship bills SOPA and PIPA. Many websites “blacked out” in protest and asked visitors to sign an online petition. Google reports that 4.5 million people added their name to an online petition to Congress to oppose internet censorship. Possibly in response to these actions, Lamar Smith, the main sponsor of SOPA, announced on Friday that he would delay further action on the bill.

New international version of SOPA seeks to create a transnational enforcement agency to make arrests and shut down sites that link to copyrighted material.

Huffington Post reports a small victory against SOPA (H.R. 3261 “Stop Online Piracy Act”) and it's counterpart in the Senate, PIPA (“Protect IP Act”), claiming that President Obama will not support the current legislation. A statement released on behalf of the Obama Administration states, “... we will not support legislation that reduces freedom of expression, increases cybersecurity risk, or undermines the dynamic, innovative global Internet.
