Recently, there has been a victory and a defeat regarding the indefinite detention provision of the Fiscal Year (FY)2012 National Defense Authorization Act (NDAA). Pulitzer Prize winning journalist Chris Hedges filed a lawsuit against President Obama and Defense Secretary Leon Panetta claiming the provision, as applied, violates the 1st and 5th Amendments. U.S. District Judge Katherine B. Forrest not only gave Hedges standing to challenge the law, she also issued an injunction to halt the legalized kidnappings!

In a rare move, a federal judge has struck down part of a controversial law signed by President Obama that gave the government the power to indefinitely detain anyone it considers a terrorism suspect anywhere in the world without charge or trial — including U.S. citizens. Judge Katherine Forrest of the Southern District of New York ruled the indefinite detention provision of the National Defense Authorization Act likely violates the First and Fifth Amendments of U.S. citizens.

Obama has just signed into LAW the National Defense Authorization Act for Fiscal Year 2012. Section 1021 of this act calls for indefinite detention without trial for those deemed "terrorists". Section 1022 requires that persons arrested and detained under the provisions of section 1021 are required to be held by the U.S. Armed forces. This may or may not include lawful resident aliens. Shame on you Obama. Shame on you U.S. Senate. Shame on you John McCain and Carl Levin. Welcome to the Police State.
