Mom of Autistic Son Facing Jail Time for Tardies

A Michigan mother of an autistic boy faces up to three months in jail after a truancy charge stemming from more than a hundred separate incidents of absences and tardiness over the last few years.

Last February a student at Fulmore Middle School says she received a ticket for "disruption of class" after spraying perfume on herself.

"I didn't do anything wrong," said 13-year-old Sarah, who was in the sixth grade at the time she was ticketed. "I thought I didn't smell good and the next thing you know, the whole class complains for no reason."

Mark Denicore and his wife appeared in court in Loudoun County Monday morning for allegedly failing to get their three children to school on time. According to Loudoun County Public Schools, between one and 30 minutes late is tardy. The Denicore children have been tardy at least 30 times this year alone -- almost one out of every three days, according to Wayde Byard, of the school district. It falls under the state’s truancy code. The Denicores’ trial date is March 14. The violation is a Class 3 misdemeanor.

Cole arrived to school Monday morning and reached behind the seat of his truck to get his book bag. He suddenly realized he'd accidentally left his shotgun in his vehicle after bring out fishing and shooting over the weekend and that it needed to be returned home immediately.

"When we put him back in school this year, within three weeks, he missed 10 days with a respiratory infection," Melissa Asselin said. That's when she had an a-ha moment. "When he was out of school, he was well.

A student was recently suspended from school for having red eyes. In Trophy Club, Texas, 16-year-old Kyler Robertson chose to attend classes just two days after his father was stabbed to death. His mother had urged the grief-stricken boy to stay home, but Kyler said he wanted the comfort of his friends.

Three parents were arrested last week because their children had been truant too many times, officials said Wednesday. The consequences for parents arrested for their child's truancy include up to one year in county jail and/or a $2,000 fine for each child not in compliance. "Sometimes we have to reinforce the idea that it is a crime to not send your child to school," said Chief Deputy DA Karen Bell. "We don't want to take that route, but some parents force our hand and give us no other choice but to file criminal charges."
