The Phoenix City Prosecutor’s office made a bold statement in its Motion to Dismiss 20 cases against Occupy Phoenix protesters yesterday, citing Paul Revere, the Tea Party and the constitutional right to protest. Members of The Phoenix 20 were individually represented pro bono by a troop of 17 volunteer defense attorneys. Originally 45 defendants faced charges, but 25 pled guilty to lesser charges. The cases were grouped together and involved trespassing and loitering allegations.

PHOENIX (CN) - A homeowner says a Phoenix police officer shot him six times in the back during a 911 home-invasion call, and the 911 tape recorded the officer's partner saying, "That's all right. Don't worry about it. I got your back. ... We clear?" The family says the officers were not aware that the 911 call was still recording as they spoke about covering up the shooting.

AP) - A South Carolina jail was sued Wednesday over its policy barring inmates from having any reading materials except the Bible.

The American Civil Liberties Union filed the federal lawsuit seeking to overturn the policy on behalf of Prison Legal News, a monthly journal on prison law. The 16-page complaint says officials at the Berkeley County jail in Moncks Corner, about 100 miles southeast of Columbia, are violating several of the magazine's and inmates' constitutional rights including free speech, freedom of religion and right to due process.

A 13-year-old Pennsylvania boy is suing a private residential school for discrimination after it refused to admit him because he has HIV, his attorneys said.The eighth grader, whose name wasn't disclosed in a federal lawsuit filed in Philadelphia, alleges that the Milton Hershey School in Hershey, Pennsylvania, "violated multiple anti-discrimination laws that protect the rights of people with HIV to remain free from unwarranted discrimination."

PHOENIX—An appeals court has issued a ruling that upholds the right of authorities to prosecute pot smokers in Arizona for driving under the influence even when there is no evidence that they are actually high.

The ruling by the Court of Appeals focuses on the chemical compounds in marijuana that show up in blood and urine tests after people smoke pot. One chemical compound causes drivers to be impaired; another is a chemical that stays in people's systems for weeks after they've smoked marijuana but doesn't affect impairment.

It all started when Espey decided to re–shingle his roof after discovering a leak.

Espey says, "The building inspector came along and told me I couldn't do it. He told me I had to quit and take off the shingles and start over because they have a code. I was kind of getting disturbed a little bit, somebody telling me what I can do on my home."

Nevertheless, on March of last year he was found guilty of four counts of violating building code and two counts of violating a stop work order, fined over $2000 and sentenced to 90 days in jail, 60 with good behavior.
