A Cook County judge today ruled that a Chicago police officer accused of drunk driving in a fatal crash on Thanksgiving 2007 was arrested and detained without probable cause.

Judge Thomas V. Gainer Jr. also called the police lieutenant who ordered Officer John Ardelean's arrest not a credible witness.

"Probable cause to arrest in this case comes down to the credibility of Lt. (John) Magruder and this court does not believe Lt. Magruder's testimony," Gainer wrote in his opinion.

Give the man his marijuana. That was the gist of a simple order Tacoma Municipal Court Judge Jack Emery gave to Tacoma police two months ago. Police refused. Thursday, Emery repeated himself with emphasis: Police have seven days to comply with his Feb. 28 order and return the pot to Tacoma resident Joseph L. Robertson, or face a possible order of contempt. “Appeal or comply,” Emery told assistant city attorney John Walker. “Or next week, show up, and I would advise you to bring counsel.”

A Mississippi judge ordered an attorney to spend several hours in jail Wednesday after the attorney chose not to recite the Pledge of Allegiance in court. The Northeast Mississippi Daily Journal reported that Chancery Judge Talmadge Littlejohn told a court audience to rise and say the pledge. People in the courtroom said Danny Lampley of Oxford stood but did not say the words.

Records show Lampley was booked into the Lee County jail at 9:40 a.m. and released about 2:30 p.m. on the judge's orders.

In a case going back to 2010, a Colorado judge has ruled that a woman named as a defendant in a criminal case can be forced to decrypt the contents of her laptop and files. Answering the question of 'what about her fifth amendment right to non-self-incrimination, the judge ruled the fifth amendment does not apply in this case, even though the contents of the protected files could be used to prosecute and convict her.
