Patrick J. Cunningham, chief of the Criminal Division of the U.S. Attorney’s office in Phoenix, will invoke his right to remain silent under the Fifth Amendment, and not testify before the House Committee on Oversight and Government Reform or its investigators about his role in, or knowledge about, Operation Fast and Furious.

A panel of marijuana criminal defense attorneys on the opening day of NORML's 39th Annual National Conference in Portland Thursday were unanimous and emphatic on one thing people with pot should do when confronted by police: exercise their right to remain silent.

A third person is now in jail for remaining silent in front of a grand jury. This is stemming from the same incident in Portland in which authorities raided a house looking for black clothing and "anarchist" literature. Though the 3 have not been charged with crimes themselves they are now all in prison for not testifying.

For the fifth time in less than two months, Austin police arrested a man while video recording them in public. This time it was Joshua Pineda, 26, a member of the Peaceful Streets Project, the organization that focuses on video recording police as they interact with the public. But this time, they did not confiscate his phone, which most likely was a result of Pineda exercising his right to remain silent while incarcerated.

Julian P. Heicklen sat silent and unresponsive as his bail hearing began one day recently in federal court in Manhattan; his eyes were closed, his head slumped forward.

With less than four and a half months until Election Day, Senate Republicans are shutting off the bipartisan spigot when it comes to confirming President Barack Obama’s nominees to the nation’s top courts and will present a unified front against his circuit court picks through November. Senate Minority Leader Mitch McConnell (Ky.) made the decision to blockade nominations official Wednesday when he informed his colleagues that he would invoke the “Thurmond Rule” from now until after the elections.

Last October the Amsterdam Court ruled that three former Pirate Bay operators had to remove a list of ‘infringing’ torrents from the website and block access to Dutch users. The Pirate Bay trio had to comply with the Court’s demands before today, but nothing has changed and it’s unlikely that the Dutch will be shut out of the site in the near future.

Justin Holmes was "pulled over" while inline skating and told that this activity was illegal under a local ordinance (untrue).

Its a long video but well worth the time. Justin maintains complete composure when faced with overwhelming odds and does what everyone who is bullied by armed thugs should do. Remain calm, remain respectful but stand your ground.
