"Music labels and radio broadcasters can't agree on much, including whether radio should be forced to turn over hundreds of millions of dollars a year to pay for the music it plays. But the two sides can agree on this: Congress should mandate that FM radio receivers be built into cell phones, PDAs, and other portable electronics.

Unlocking cell phones will be illegal on January 26,2013 because of a determination by the Librarian of Congress under the Digital Millennium Copyright Act (DMCA).

Transportation Secretary Ray LaHood said using a cell phone while driving is so dangerous that devices may soon be installed in cars to forcibly stop drivers — and potentially anyone else in the vehicle — from using them... “There’s a lot of technology out there now that can disable phones and we’re looking at that.”
“Am I on a rampage,” said LaHood, who has made distracted driving a top priority of his tenure, “Yes, I am, and why shouldn’t I be?”

Several months ago, as a way to prevent the use of cellular phones in criminal activities, the government of Mexico started a program to require all phone owners to register cell phones in their own names. The registry associates each phone with the listed owner's Clave Unica de Registro de Poblacion (CURP) [CURP, in English], which is supposed to be a unique ID for every Mexican citizen.

NEW YORK -- Alarmed by the use of hard-to-track prepaid cell phones by terror suspects, New York Sen. Chuck Schumer and Texas Sen. John Cornyn have introduced legislation requiring consumers to produce identification before buying such phones.

The Michigan State Police have a high-tech mobile forensics device that can be used to extract information from cell phones belonging to motorists stopped for minor traffic violations. The American Civil Liberties Union (ACLU) of Michigan last Wednesday demanded that state officials stop stonewalling freedom of information requests for information on the program.

Whenever possible, when the law is ambiguous or silent on the issue at bar, the courts should let those who want to market new technologies carry the burden of persuasion that a new exception to the broad rights enacted by Congress should be established. That is especially so if that technology poses grave dangers to the exclusive rights that Congress has given copyright owners. Commercial exploiters of new technologies should be required to convince Congress to sanction a new delivery system and/or exempt it from copyright liability. That is what Congress intended.
