Today I was harassed and ticketed by the Metropolitan Transportation Authority police at the entrance to the Long Island Railroad portion of Penn Station on W. 34th St. for lawfully photographing armed soldiers and police. Please excuse the darkness of the majority of this piece of media as I had the video cam in my pocket to pick up audio which goes in and out at times but gives you an idea of some of that which was said by the officers and myself.

The DHS admits that the § 102-74.420 does not “prohibit individuals from photographing (including motion photography) the exterior of federal courthouses from publicly accessible spaces, such as streets, sidewalks, parks and plazas; and FPS has not construed any other federal regulation or federal statute to prohibit such photography of the exterior of federal courthouses, though it makes no representation about local rules or orders.”

The New York Civil Liberties Union today filed a lawsuit challenging a government regulation that unconstitutionally restricts photography on federal property, including public plazas and sidewalks.

Homeland security releases document telling officers to allow photography of government buildings. The document says, ""officers should not seize the camera or its contents, and must be cautious not to give such 'orders' to a photographer to erase the contents of a camera, as this constitutes a seizure or detention."
