Attorney General Eric Holder recently gave a speech in which he said the U.S. military can execute American citizens without trial, because “’[d]ue process’ and ‘judicial process’ are not one and the same, particularly when it comes to national security.” Holder added, “[t]he Constitution guarantees due process, not judicial process.”

Without evidence, charges, trial, or due process, President Obama has ordered the murder of an American citizen based on allegations of ties to terrorism. Congressman Ron Paul and Judge Andrew Napolitano blast this latest step down the road to tyranny. It's no longer a stretch to imagine this power being used to remove political opponents or those who criticize the government or who voice dissenting views.

Dr. James David Manning, The Atlah World Missionary Church, calls this the “Trial of the Century” and the “Greatest Trial in American History.” He says the proceedings are not a mock trial and are permitted under the U.S. Constitution.

The American Civil Liberties Union failed in late-2010 to push a lawsuit challenging the Obama Administration’s claimed power to assassinate American citizens without charging them with any crimes, but is hoping for a consolation prize today, filing another suit challenging the killings after the fact. “It’s an effort to get accountability,” noted ACLU deputy director Jameel Jaffer, saying that even though the Justice Department successfully argued that the killings couldn’t be challenged beforehand, they could now press the administration to “explain to a court why it did what it did.”

The New York Times reports that President Obama has created an official “kill list” that he uses to personally order the assassination of American citizens. Considering that the government already has a “Do Not Call” list and a “No Fly” list, we hereby request that the White House create a “Do Not Kill” list in which American citizens can sign up to avoid being put on the president’s “kill list” and therefore avoid being executed without indictment, judge, jury, trial or due process of law.

The Senate is gearing up for a vote on Monday or Tuesday that goes to the very heart of who we are as Americans. The Senate will be voting on a bill that will direct American military resources not at an enemy shooting at our military in a war zone, but at American citizens and other civilians far from any battlefield — even people in the United States itself.

The Senate is going to vote on whether Congress will give this president—and every future president — the power to order the military to pick up and imprison without charge or trial civilians anywhere in the world.

In a rare move, a federal judge has struck down part of a controversial law signed by President Obama that gave the government the power to indefinitely detain anyone it considers a terrorism suspect anywhere in the world without charge or trial — including U.S. citizens. Judge Katherine Forrest of the Southern District of New York ruled the indefinite detention provision of the National Defense Authorization Act likely violates the First and Fifth Amendments of U.S. citizens.

One of the most controversial parts of this excessive bill is the inclusion of a provision that allows for the indefinite detention of terror suspects which can include American citizens, without a trial. The battlefield on the so-called “war on terror” has been expanded now to include the United States and its territories. This allows for anyone considered to be a combatant or supporter to be subject to detention by the military, without allowing for a trial to prove innocence of the charges levied.

Congress has failed in keeping Obama's power in check. Not just in power restricting him in his war powers. Also on many fronts, we have seen an executive power grab on a scale never seen before.
