This morning, the federal court ruled that the “naked scans” of air travelers do not violate Americans’ constitutional rights. Privacy rights group EPIC had sued the Department of Homeland Security, alleging violations of innocent passengers’ Fourth Amendment right to be free of unreasonable searches. The court says that argument doesn’t fly.

"Full body scanners and enhanced pat downs in private rooms are fueling anger among air travelers in the US. The Transportation Security Administration (TSA) is coming in for severe criticism while passengers are planning a boycott of the scans on Nov. 24 - traditionally the busiest travel day of the year."

If you don't want to pass through an airport scanner that allows security agents to see an image of your naked body or to undergo the alternative, a thorough manual search, you may have to find another way to travel this holiday season.

The Transportation Security Administration (TSA) is warning that any would-be commercial airline passenger who enters an airport checkpoint and then refuses to undergo the method of inspection designated by TSA will not be allowed to fly and also will not be permitted to simply leave the airport.

Full-Body Scan Technology Deployed In Street-Roving Vans
As the privacy controversy around full-body security scans begins to simmer, it’s worth noting that courthouses and airport security checkpoints aren’t the only places where backscatter x-ray vision is being deployed. The same technology, capable of seeing through clothes and walls, has also been rolling out on U.S. streets.

"Air passengers already tolerate a large invasion of their privacy," the committee said in a report, citing pat-downs and bag searches as specific examples. "We do not feel that full body scanners add greatly to this situation."

The privacy fears raised by the deployment of full body scanners at airports are overblown, a committee of British lawmakers said Wednesday, adding that the technology was no more of a threat to passengers' rights than pat-downs or bag searches.

A growing number of airline passengers, labor unions, and advocacy groups, say the new procedures--a choice of full-body scans or what the TSA delicately calls "enhanced pat-downs"--go too far.

Michael Roberts, a pilot for ExpressJet Airlines, who refused to submit to a full-body scan or the alternative pat down going through airport security said the procedures violate his rights. Roberts says he has safety concerns, but called TSA a "make-work" program that doesn't make travel safer.

1) Fly within the United States, opt out of the body scanner and have someone film your pat-down.
2) Go to your nearest U.S. airport and hand out flyers to travelers to spread the word about the event.
3) Film TSA personnel at non-airport locations, like subways, train stations and bus stops, and peacefully re-assert your rights when faced with random bag searches and other unreasonable security procedures.
