The Food, Drug and Cosmetic Act makes it illegal to sell a prescription drug for any purpose other than what's listed on the label. Nevertheless, a divided federal appeals court this week tossed out the conviction of a former drug sales rep who was recorded pitching a doctor on other uses of a medicine approved by regulators solely to treat the sleep disorder narcolepsy.

How the FDA Monitored Scientists Who Raised Concerns over Radiation

The Food and Drug Administration has been found to have launched a massive surveillance campaign targeting its own scientists for writing letters to journalists, members of Congress and President Obama. The scientists were expressing their concern over the FDA’s approval of medical imaging devices for colonoscopies and mammograms that could endanger patients with high levels of radiation.

Feds shut down Amish farm for selling fresh milk

The FDA has won its two-year fight to shut down an Amish farmer who was selling fresh, raw milk to eager consumers in the Washington region, after a judge this month banned Daniel Allgyer from selling his milk across state lines, and he told his customers he'll shut his farm down altogether.

Walnuts Are Drugs, Says FDA

Seen any walnuts in your medicine cabinet lately? According to the Food and Drug Administration, that is precisely where you should find them. Because Diamond Foods made truthful claims about the health benefits of consuming walnuts that the FDA didn’t approve, it sent the company a letter declaring, “Your walnut products are drugs” — and “new drugs” at that — and, therefore, “they may not legally be marketed … in the United States without an approved new drug application.” The agency even threatened Diamond with “seizure” if it failed to comply.

Yes folks, the FDA's fund-raising measures have resulted in drug shortages and the all-seeing, all-knowing, all-benevolent master obamarama has now ordered the FDA to reduce the drug shortages that it successfully prevented by creating in the first place.

Sneak Attack on Supplements: FDA Regulation

Today, both the FDA and Sen. Dick Durbin (D-IL) dropped policy “bombs” on those of us who use dietary supplements. It is no mere coincidence that both were released on the Friday before a holiday weekend. By timing the introduction of their anti-supplement legislation and regulatory guidance this way, the FDA and Sen. Durbin are both hoping to evade negative publicity. We think it is better to keep American citizens fully informed, and with your help, we will get the word out. Please send this communication far and wide.
